No. A Florida referral agent cannot write contracts, represent buyers or sellers, negotiate on anyone's behalf, or participate in any part of a real estate transaction beyond making the referral itself.

Here's what the referral agent role actually includes:

  • Identifying people in your network who are thinking about buying or selling

  • Connecting them with a licensed active agent who will handle the transaction

  • Signing a referral agreement through your brokerage

  • Earning a referral fee when the transaction closes

Here's what it does not include:

  • Writing or reviewing purchase agreements or contracts

  • Advising buyers on offer strategy or price

  • Attending showings, inspections, or closings in a professional capacity

  • Negotiating terms on behalf of either party

  • Acting in any way as a transaction agent or representative

The reason is straightforward: when your license is held at a referral-only brokerage in Florida, you are not authorized to practice real estate in a transactional capacity. You are a licensed professional whose scope is limited to the referral itself. The active agent — and their brokerage — handle everything after the handoff.

This boundary actually works in your favor. Your liability exposure is dramatically lower than an active agent's. You're not responsible for disclosures, contract deadlines, or negotiation outcomes. Your job ends at the introduction.
