Can a Florida Referral Agent Work With a Buyer Directly Before Submitting a Referral?

Can a Florida referral agent answer a buyer's questions, help them think through their search, or accompany them to a showing — as long as no one has signed anything yet?

No. The absence of a signed buyer agreement doesn't change what a referral agent is and isn't authorized to do. A Florida referral agent cannot represent, advise, or assist a buyer or seller in any transactional capacity — regardless of whether paperwork has been signed.

This is a boundary that trips up agents who are new to the referral model, especially those who came from active sales and are used to helping informally before anything official is in place.

Where the line is:

As a Florida referral agent, your role begins and ends with the connection. You can have a conversation with someone in your network to understand that they're thinking about buying or selling. You can ask enough questions to know what kind of agent would be a good match for them. And you can make the introduction by submitting a referral through your brokerage.

What you cannot do is advise them on neighborhoods, help them evaluate listings, discuss what price range makes sense, attend a showing with them, or weigh in on any aspect of their real estate decision — even casually, even before anyone has signed anything.

Why this matters:

When your Florida real estate license is held at a referral-only brokerage, your authorized scope is narrowly defined. Stepping outside that scope — even informally — creates liability exposure for you and your brokerage, and potentially jeopardizes the referral fee you're entitled to earn.

The cleanest approach: once you identify that someone is thinking about real estate, refer them promptly. The sooner the active agent is in the picture, the sooner your client is getting proper representation and the sooner your referral is protected.

The good news:
