What Is the Minimum Referral Fee in Florida Real Estate?
Is there a minimum referral fee set by Florida law — and what should a Florida referral agent expect to earn?
Florida real estate law does not establish a mandatory minimum referral fee. Referral fees are negotiable between the referring agent's broker and the receiving agent's broker, and the final percentage is whatever both parties agree to in writing through a signed referral agreement.
That said, there is a widely accepted industry standard: 25% of the gross commission earned by the receiving agent at closing. This has become the baseline most agents and brokerages default to when no other amount has been negotiated in advance.
What affects the percentage:
The referral fee percentage is typically discussed and agreed upon before the referral is submitted — ideally before the referral agreement is drafted. Factors that can influence the negotiated percentage include the strength of the relationship between the referring and receiving agent, the anticipated value of the transaction, and market norms in the receiving agent's area.
Some referral agents negotiate higher percentages — 30% or more — particularly when referring a high-value transaction or a client with a strong timeline and motivation. Others accept the standard 25% as a straightforward baseline that keeps the relationship simple and the receiving agent incentivized to perform.
What Florida law does require:
While there's no minimum fee, Florida law does require that all referral fee arrangements between licensed agents be documented in a written referral agreement, that both brokers sign off, and that the fee flow through the brokers — not directly between agents. A verbal agreement or handshake deal is not enforceable and puts your referral income at risk.
